Grey Bug Photography aims to meet the highest standards in every aspect and takes great pains to work diligently with customers to approve designs and custom work before orders are placed. Grey Bug is an ethical company that stands by its products and services and expects its customers to be honest in return.

Scheduling

This will include 100% of the total cost at the time of signing this agreement. 50% of the cost is a NON-REFUNDABLE RETAINER. In the event of cancellation, the retainer paid is nonrefundable. It shall be liquidated for damages to Grey Bug Photography in the event of a cancellation, or breach of contract by the CLIENT. The CLIENT shall also be responsible for payment of any materials/charges incurred up to the time of cancellation. The retainer shall be applied towards the total cost of the service to be rendered. The remaining charges are payable in full on the date of the session.
GREY BUG PHOTOGRAPHY CONSIDERS A SESSION BOOKED ONLY WHEN RECEIPT OF BOTH PAYMENTS AND THIS SIGNED CONTRACT.  It reserves the right to book other clients for the desired session until both payment and contract are received. RATES ARE SUBJECT TO CHANGE WITHOUT NOTICE. Clients will receive rates posted at the time of booking. Creative fees are for “time and talent”, do not include the product of any kind unless stated above. AN APPOINTMENT MAY BE CANCELED AT ANY TIME IF NOT PAID. 

Weather Conditions

The weather is unpredictable and may impede the photo session scheduled for that day. In the event of bad weather, CLIENT may reschedule without additional fees. Grey Bug Photography will provide the CLENT with alternative dates or the CLIENT may reschedule online. The CLIENT may choose to cancel the session if unable to reschedule and the CLIENT will receive a full refund minus any travel, or equipment fees if applicable.

Cooperation

The parties agree to cheerful cooperation and communication for the best possible result within the definition of the assignment. Grey Bug Photography is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to Grey Bug Photography.

Rescheduling / Late Arrival

: If CLIENT wishes to reschedule a session, all amounts paid are NON-REFUNDABLE. In the event of a postponement, notice must be given at least 2 weeks before the scheduled time and must be rescheduled within the same calendar year. Late arrivals will have the amount of time late deducted from the total time allotted for the session

Limit of Liability

In the unlikely event that the photographer is injured or becomes too ill or has an extreme emergency that prevents him or her from photographing the event, Grey Bug Photography will make every effort to reschedule the event. If for whatever reason this is not possible, responsibility and liability are limited to the return of all payments received for the package purchased. Grey Bug Photography takes the utmost care concerning exposure, transportation, processing, and archiving the photographs. However, in the unlikely event that the photographs have been lost, stolen, or destroyed for reasons within or beyond Grey Bug Photography’s liability is limited to the return of all payments received for the photo session or package. The limitation on liability shall also apply if photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost in damage without fault on the part of the photographer or Grey Bug Photography. In the event the Studio/Photographer fails to perform for any other reason, the Studio/Photographer shall not be liable for any amount over the retail value of the client’s order.

Physical Liability

Clients are responsible for their conduct at all times. Any breakage or
damage to the equipment or studio contents is the sole financial responsibility of the client. Clients
agree to hold Grey Bug Photography and its agents harmless from any injuries or damages sustained
preceding, during, and immediately following a session. In the event the Client’s behavior becomes
abusive to the photographer or a member of Grey Bug Photography’s team, the Client will be asked
to leave, the session canceled, and all payments forfeited to Grey Bug Photography.

Images & Copyright

The photographs produced by Grey Bug Photography are protected by
Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without the
written permission of Grey Bug Photography. COMMERCIAL USE OF IMAGES IS STRICTLY
PROHIBITED except for the defined uses in the licensing agreement. Images may not be entered into
any contest or submission without prior written authorization. Online images will be locked.
Screengrab downloads, the printing of digital images, and the scanning of prints for digital imagery
use are illegal and punishable by law. Disks provided to the client with web-sized watermarked
images are not to be reproduced and are for displaying on social networking sites, email, and online
forums online. WATERMARKS ARE NOT TO BE CROPPED OUT UNLESS PAYMENT IS
RECEIVED TO DO SO

You may only use the Content for personal use only on your personal devices only. For clarity, you
may not use the Content in products for resale, license, or any other distribution. For example, you
cannot superficially modify the Content, print it on a t-shirt, poster, template or any other item, and sell
it to others for consumption, reproduction or re-sale. That would be unethical. Any use of the Content
that is not a Permitted Use shall constitute an infringement of copyright.

Seat Restrictions

Only you are permitted to use the Content for personal use, although you may transfer files among
your devices such as phone, tablet, laptop, or desktop computer. You may install and use the Content
in only one location at a time for each file, although there is no time limit on the duration you can use
it for. You may physically transfer the Content from one location to another i.e.: distributing it among
your devices. If you require the Content to be in more than one location or accessible by more than
one person, you must download the Content from the Site for each such use or individual. You may
make only one (1) copy of the Content solely for backup purposes.

Any additional permitted uses must be approved in writing by Grey Bug Photography.

If there is any doubt that a proposed use is a Permitted Use, you should contact Grey Bug
Photography for guidance at 844-GREY-BUG.

Proofing

Once the job is complete The CLIENT may choose to have the editor choose the most
viable photos or choose from a contact sheet. Once photos are complete, The CLIENT will be
emailed a link that will direct them to their photos. All photos will have a PROOF watermark across
each photograph. The final product will not have this watermark. Once the CLIENT has agreed to the
quality of the photography and is satisfied with the product, the CLIENT will notify Grey Bug
Photography through email, text, or writing within 7 days that they are satisfied. Once the CLIENT is
satisfied, Grey Bug Photography will release photos according to the agreement. CLIENT must
approve photos within 7 days. After 7 days, photos will be released, and the contract will be
considered fulfilled.

Digital Photography

Due to the digital nature of the photography, refunds are only issued if the customer is not satisfied
with the product before receiving digital copies (original). If for any reason the customer receives the
digital, original format of the pictures, payment will be considered complete. Photos are distributed
through a third-party website called SmugMug or GotPhoto which gives the customers the ability to
view proofs. See the DOWNLOADING page for details on how to download the original format photos
or print professional-quality photos

Downloading Terms

By downloading the content from our site, you accept this Agreement and agree to be bound by its
provisions. Once the content is downloaded you hereby grant perpetual, non-exclusive, nontransferable, worldwide permission to use the Content for the Permitted Uses only (as defined below).
Unless the activity or use is a Permitted Use, you cannot do it. All rights in and to the Content, including, without limitation, all copyright and other intellectual property rights relating to the Content,
are retained by Grey Bug Photography.

Custom Work

Due to the custom pre-design nature of these services, there are no refunds on any design order.
Albums ordered are considered a custom product and therefore there are no refunds on any album
orders.

Prints and Marketing Material

Prints and marketing material is done through 3rd party companies. We utilize a myriad of labs that
offer selected services to accommodate the client’s needs

Payments

Payments can be made by credit card, PayPal, cash, check. Paying by check will require
the payment to clear before releasing photos from watermarks and or download options. If payment is
returned for any reason all use of photographs downloaded will cease, photographs will be locked on
the site and restricted from download until payments have been made with a 35 NSF Fee and will be
applied to your account in addition to any fees applied by your bank at 10% interest after 30 days
every month thereafter until the balance is paid in full. The client also understands that there is a $.45
per mile charge for any travel over 30 miles and an additional cost for some locations is to be paid
within 30 days of the session or there will be a 10% interest applied to the account and no products
will be delivered until paid in full.
